These Artist Participation Terms & Conditions (“Terms”) apply to artists participating in exhibitions, art shows, curated showcases and related programmes organised or presented by Sagar’s Art Stream (“Sagar’s Art Stream”, “we”, “us” or “our”).

By submitting an application, accepting an approval, making any payment, submitting artwork, or participating in an exhibition organised by Sagar’s Art Stream, the artist (“Artist”, “you” or “your”) confirms that they have read, understood and accepted these Terms.

1. APPLICATION, SELECTION & CURATION

1. Participation in any exhibition organised by Sagar’s Art Stream is subject to curatorial approval.

2. Submission of an application or artwork does not guarantee selection or participation.

3. Sagar’s Art Stream reserves the right to accept, decline or modify an artist’s participation based on curatorial requirements, exhibition concept, available space, venue requirements, artwork suitability or other organisational considerations.

4. Curatorial decisions regarding artwork selection, placement, display sequence, grouping and presentation shall remain at the discretion of Sagar’s Art Stream and its appointed curators.

5. Artwork placement may be changed before or during an exhibition for curatorial, spatial, technical, operational, safety or venue-related reasons.

6. No particular wall, position, visibility, visitor footfall, proximity to another artist, curator, master artist, guest, VIP or institution is guaranteed.

2. PARTICIPATION FEE, PAYMENT & REFUNDS

1. The participation fee is payable towards the artist’s confirmed participation and the associated curatorial, venue, display, handling, coordination, promotional, administrative, logistical and organisational arrangements.

2. All participation fees, advance payments and other amounts paid towards participation are non-refundable once participation has been confirmed or payment has been made, except where Sagar’s Art Stream expressly agrees otherwise in writing or where a refund is required under applicable law.

3. The non-refundable policy applies even if an artist subsequently:

withdraws from the exhibition;

chooses not to attend;

removes their artwork;

becomes unavailable;

changes their plans;

disagrees with artwork placement;

does not provide promotional material;

does not attend the opening or exhibition;

sells the artwork elsewhere; or

otherwise chooses not to continue participation.

4. Partial payments and advance payments are subject to the same non-refundable policy. Also once a 50% advance is paid, the balance 50% has to be paid on compulsory basis else the participant is disqualifed and the 50% advance will also not be considered for participation. 

5. Once participation is confirmed, Sagar’s Art Stream may commit venue, production, logistics, staffing, publicity, promotional, administrative and other resources on the basis of that participation.

6. Any exception to the refund policy or adjustment in next exhibition must be specifically approved by Sagar’s Art Stream in writing.

3. EXHIBITION DATES, VENUE & OPERATIONAL CHANGES

1. Exhibition dates, timings, venue arrangements and operational schedules may be subject to reasonable changes due to venue requirements, technical issues, government restrictions, security requirements, operational circumstances, force majeure events or other matters beyond the reasonable control of Sagar’s Art Stream.

2. Temporary interruptions involving electricity, lighting, air conditioning, internet, access, security, venue staffing or other infrastructure shall not automatically constitute grounds for a refund.

3. Sagar’s Art Stream will make reasonable efforts to address operational issues and restore normal exhibition functioning as soon as reasonably practicable.

4. Exhibition venues may be operated or managed by third parties, and certain services and infrastructure may therefore be outside the direct control of Sagar’s Art Stream.

4. ARTIST WITHDRAWAL & REMOVAL OF ARTWORK

1. An artist may communicate their decision to withdraw from an exhibition; however, withdrawal does not automatically entitle the artist to a refund.

2. If an artist withdraws after participation has been confirmed, Sagar’s Art Stream shall retain the right to retain amounts already paid in accordance with these Terms.

3. Removal of artwork from an exhibition without prior written approval may be treated as artist-initiated withdrawal.

4. Any artwork removed from an exhibition by the artist or their authorised representative may be documented by Sagar’s Art Stream or the venue for administrative and record-keeping purposes.

5. ARTWORK SUBMISSION, TRANSPORTATION & HANDLING

1. Artists are responsible for ensuring that artworks reach the designated submission location within the specified deadline and in appropriate condition.

2. Artwork must be properly packed, labelled and ready for exhibition.

3. Unless specifically stated otherwise for a particular exhibition, travel, accommodation, framing, special packaging, insurance and other artist-specific expenses shall be borne by the artist.

4. Where transportation is included in the participation fee, the scope of transportation shall be as communicated for the relevant exhibition.

5. Sagar’s Art Stream will exercise reasonable care in handling artworks but cannot accept responsibility for loss or damage arising from inadequate packaging, inherent defects, fragile construction, improper framing, natural deterioration, artist-supplied materials or circumstances beyond reasonable control.

6. ARTWORK INFORMATION & AUTHENTICITY

1. The artist is solely responsible for the accuracy of all information supplied to Sagar’s Art Stream regarding the artist name, artwork title, dimensions, medium, year, price, description, biography, ownership and authenticity of the artwork.

2. By submitting an artwork, the artist confirms that they have the legal right to exhibit and, where applicable, sell the artwork.

3. The artist shall be responsible for any claim arising from inaccurate information, unauthorised use of third-party material, copyright infringement, ownership disputes, false representation or authenticity disputes relating to the artwork.

7. ARTWORK SALES

1. Unless otherwise stated in writing, the artist determines the selling price of their artwork.

2. Sagar’s Art Stream may facilitate enquiries and sales but does not guarantee that any artwork will be sold.

3. Exhibition participation does not constitute a guarantee of sales, collectors, buyers, visitor numbers, enquiries or commercial returns.

4. Where a zero-commission arrangement applies, the artist retains the agreed sale value subject to the specific commercial terms communicated for that exhibition.

5. Any applicable taxes, payment processing charges, shipping, packaging or other transaction-related expenses shall be dealt with according to the terms communicated for the relevant exhibition.

8. PROMOTION, PR & DIGITAL VISIBILITY

1. Sagar’s Art Stream may promote participating artists through social media, websites, press releases, media articles, digital campaigns, photography, videography, interviews, Reels, Stories, catalogues, brochures and other promotional channels.

2. Promotional activities form part of the exhibition’s overall communication strategy and do not constitute a guarantee of a specific number of posts, publications, interviews, articles, views, followers, enquiries, sales or media placements.

3. Media coverage is subject to the editorial discretion and publication decisions of third-party media organisations.

4. Sagar’s Art Stream does not guarantee publication by any particular media organisation in promotions

5. Artists authorise Sagar’s Art Stream to use their name, artist biography, submitted artwork images, exhibition photographs, videos and related material for legitimate exhibition promotion, communication and archival purposes.

9. PHOTOGRAPHY & VIDEOGRAPHY

1. Professional photography and videography may be undertaken during an exhibition.

2. Photography and video content may be sorted, edited and released in phases following the exhibition.

3. Individual photographs or videos may not be immediately available following an exhibition.

4. Sagar’s Art Stream does not guarantee that every artist will appear in every photograph, video, Reel, interview or promotional asset.

5. Where an artist is not present during an arranged photography or video session, Sagar’s Art Stream is not obligated to arrange a separate professional session solely for that artist unless separately agreed.

10. EXHIBITION EXPERIENCE & VENUE SERVICES

1. Exhibition venues are subject to their own operational, technical, security and safety requirements.

2. Temporary issues relating to electricity, lighting, air conditioning, internet connectivity, security, access, venue staffing or other infrastructure may occur.

3. Such temporary operational issues, where reasonable efforts are made to address them, shall not by themselves constitute a failure to provide the exhibition or create an automatic entitlement to a refund.

4. Sagar’s Art Stream does not control all services provided by third-party venues and cannot guarantee uninterrupted operation of every venue facility throughout the exhibition period.

11. VISITOR ATTENDANCE & EXHIBITION OUTCOMES

1. Published exhibition timings are subject to venue operations and may be modified where reasonably necessary.

2. Visitor numbers, collector attendance, buyer attendance, media attendance, embassy attendance, VIP attendance or attendance of any particular individual or institution cannot be guaranteed.

3. The presence or absence of any particular guest, collector, buyer, celebrity, institution, media representative or dignitary does not constitute a contractual obligation unless specifically confirmed in writing.

4. Sagar’s Art Stream does not guarantee any particular level of footfall, sales, enquiries, media exposure, social media reach or commercial outcome.

12. ARTIST CONDUCT

1. Participating artists are expected to maintain professional and respectful conduct towards Sagar’s Art Stream, its curators, staff, venue representatives, other participating artists, guests and visitors.

2. Harassment, intimidation, abusive communication, threats, deliberate disruption of an exhibition or inappropriate conduct may result in termination of participation or removal from the exhibition.

3. Such termination shall not automatically create an entitlement to a refund.

4. Nothing in these Terms prevents an artist from raising a genuine complaint or exercising any lawful right.

13. COMMUNICATION & PUBLIC STATEMENTS

1. Artists are encouraged to raise concerns directly with Sagar’s Art Stream and provide an opportunity for factual clarification before publishing allegations concerning the organisation, its personnel, venue arrangements or exhibition operations.

2. Nothing in these Terms prevents an artist from expressing a genuine opinion or exercising any legal right.

3. Knowingly false statements, fabricated allegations, threats, harassment, impersonation or unlawful use of intellectual property may be addressed through appropriate legal or other lawful channels.

14. FORCE MAJEURE

Neither Sagar’s Art Stream nor the artist shall be considered in breach of these Terms where performance is affected by circumstances beyond reasonable control, including natural disasters, fire, flood, epidemic, governmental restrictions, civil disturbance, strikes, venue closure, utility failure, technical failure, security restrictions or other unforeseen circumstances.

Sagar’s Art Stream will make reasonable efforts to reschedule, modify or otherwise manage the exhibition where reasonably possible.

Participation fees shall remain subject to the applicable refund policy and any rights required under applicable law.

15. CERTIFICATES & DOCUMENTATION

1. Certificates of Participation, artist features, catalogues, website listings and other documentation may be issued according to the specific arrangements of each exhibition.

2. The format, timing and method of delivery of such documentation may vary between exhibitions.

3. A Certificate of Participation does not constitute a Certificate of Authenticity for an artwork unless expressly stated.

16. INTELLECTUAL PROPERTY & CONTENT USAGE

1. Artists retain ownership of their artwork and underlying intellectual property unless separately agreed in writing.

2. By participating, artists grant Sagar’s Art Stream a non-exclusive right to reproduce submitted artwork images and exhibition-related photographs and videos for exhibition promotion, documentation, archival records, website content, social media, press material, catalogues and related communications.

3. This permission does not transfer ownership of the artwork or copyright to Sagar’s Art Stream.

17. PERSONAL INFORMATION

Information submitted by artists may be used for exhibition administration, communication, logistics, payment processing, promotional coordination and other legitimate purposes connected with the artist’s participation.

The handling of personal information shall be subject to Sagar’s Art Stream’s applicable Privacy Policy.

18. LIMITATION OF RESPONSIBILITY

Sagar’s Art Stream will make reasonable efforts to organise and execute exhibitions professionally. However, it does not guarantee uninterrupted venue operations, artwork sales, visitor numbers, media coverage, collector enquiries, promotional outcomes or any particular commercial result.

To the extent permitted by applicable law, Sagar’s Art Stream shall not be responsible for indirect, consequential or speculative losses arising from an artist’s participation in an exhibition.

19. CHANGES TO EXHIBITION ARRANGEMENTS

Sagar’s Art Stream reserves the right to make reasonable changes to exhibition layouts, artwork placement, schedules, promotional plans, venue arrangements and operational procedures where required for curatorial, technical, safety, logistical, venue or organisational reasons.

Material changes will be communicated where reasonably practicable.

20. ACCEPTANCE OF TERMS

By submitting an application, accepting an approval, making any payment, submitting artwork, or participating in an exhibition organised by Sagar’s Art Stream, the artist confirms that they have read, understood and accepted these Artist Participation Terms & Conditions, including the applicable payment, cancellation and refund provisions.

21. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws applicable in India. Subject to applicable law, disputes shall be subject to the jurisdiction of the competent courts at New Delhi.
